Notice of Intended Modification of Licence No 059 Issued to Kikagati Power Company Limited

In pursuance of its powers under Section 44 (4) of the Electricity Act, 1999 the Electricity Regulatory Authority (hereafter referred to as the “Authority”), hereby gives notice under Section 44 (5) as follows:

1. The Authority has approved the modification of the electricity generation and sale Licence No. 059 (the “Licence”) issued to Kikagati Power Company Limited (the “Licensee”), for the development of a hydropower plant in Isingiro District (the ‘Project’).
2. The modification is being proposed following a written request from the Licensee.
3. The proposed modification is to:-

• Facilitate the adoption of the Standard Licence templatefor the Project. Attached is a copy of the proposed ‘Amended and Restated Licence Conditions’ for ease of reference;
• Extend the Licence Term from thirty (30) years of the Effective Date of the Licence to thirty three (33) years thereof;
• Increase the capacity of the Project from 10 MW to 14 MW; and
• Facilitate the adoption of the Phase One - Renewable Energy Feed-in-Tariff (REFIT) of US cents 8.5 / kWh, for the Project.

4. The Licensee’s request for waiver of the requirement to post performance bonds to secure the Licence Conditions on the achievement of Financial Close, the Construction Start Date and Commercial Operations Date, was rejected.
5. The purpose of this Notice is to bring the proposed modification to the attention of the Public and invite representations or objections in connection thereto.
6. In line with Clause 44 (5) of the Electricity Act, 1999, any representations or objections with respect to the proposed modification may be made on or before thirty (30) days from the date of this Notice to:
